South Carolina AG releases opinion that municipalities may not delegate parking enforcement.

Columbia SC On November 15, 2024 the Office of the Attorney General for the State of South Carolina released an opinion that “police power may not be delegated to private entities absent legislative or constitutional authority… we do not believe a municipality may delegate parking enforcement to a private entity.” 


"While this is the AG’s opinion, it is an opinion that carries a lot of weight." commented Craig Bagdon, President of Enforcement Associates. "We look forward to consulting with our members on next steps to make sure that municipalities in South Carolina do not lose this important tool for outsourcing parking enforcement services."

North American Accreditation Program for Private Compliance Providers Announced at PIE 2024

Schaumburg, Illinois:  In an effort to bring consistency and standardization to a largely unregulated private parking compliance industry, Enforcement Associates announced today the launch of ParkCert.Org. ParkCert.Org will provide the stage from which the industry can move forward as a fully self-regulated and policing entity that values both consumer rights and private property rights.


All members will be subject to a complete compliance program review before accreditation is granted, which will include posting of clear and concise signage, compliance with all state & local laws, adherence to a professional Code of Conduct, and provision of an independent appeals process. Continuing membership will be subject to continuing education, onsite visits, signage review, dispute process audits, and investigation of consumer complaints.


“We look forward to making this the premier organization representing both the private compliance industry and its patrons.” says Craig Bagdon of Enforcement Associates. “With this unified voice we can bring attention to this largely misunderstood industry and aid regulators in drafting common sense legislation that benefits all.” 

Washington State DOL Makes Data Available for Commercial Parking Companies

Olympia, Wash.: “Effective November 1, 2023, the Department of Licensing (DOL) will make data available to commercial parking companies in accordance with RCW 46.12.630 (2)(e). Use of the information will be limited to notifying owners of outstanding parking violations.”


Furthermore there will be “an open house on Wednesday, November 15, 2023, regarding this announcement if you have questions or comments. Details for joining the open house appear below.”
